MY ABUSER HAS A GUN

If you have a current Protection From Abuse Order (PFA) from a court against your abuser, or if your abuser has been convicted of a felony or domestic violence misdemeanor, then Federal law states that it is illegal for your abuser to buy or have a gun in their possession.

You MUST ASK THE JUDGE to specifically write in your order that the abuser cannot buy or have a gun while the order is in effect and to require that your abuser to give any guns to the police, or require the police to go to the abuser's house and get them. The guns then go to either the county sheriff or court clerk of stolen property. The district attorney in the county where the gun(s) was taken away can then file to have them destroyed.

California's Confidential Address Program:

The "Safe At Home" program, administered by the Secretary of State, is a no cost mail forwarding service designed to help victims of domestic violence who have recently moved or are planning to relocate in the near future to a safe place unknown to their abusers. The mail forwarding service aids participants of the program in keeping their home, work, or school address confidential by providing them with a substitute address, thereby adding an extra layer of security to a victim's safety plan. Interested abuse victims can ONLY enroll at a designated domestic violence/victims assistance program facility in California. Contact Your local facility (see below) for more information.

California Unemployment Insurance Laws cover Victims of Domestic Violence .

Passed in 1998, sections 1032(b)4 and 1256 of the UI Code provides that leaving employment to protect yourself or your children from domestic violence is considered good cause. The employer's account is not charged. To establish that a person has good cause to quit due to domestic violence abuse, the Department must establish that:

1.An act or threat of domestic violence abuse occurred.
2.The claimant or the claimant's children are the intended victim of the domestic violence abuse.
3.The claimant has a restraining order, a police report, or some other information that identifies the source of the abuse and/or verifies the abuse or threat of abuse.
4.A leave of absence or a transfer was not available, or would not have resolved the problem. (e.g., the claimant has a restraining order against the abuser, but the abuser violates the restraining order.)
